General Terms of Use

1. Preamble
These Terms of Use (hereinafter "ToU") define the conditions of access to and use of the website www.jde-jobs.com (hereinafter "the Site"), published by SYMAN CONSULTING (see Legal Notice).
Access to and use of the Site implies full and unreserved acceptance of these ToU. Any User who does not accept these ToU must immediately cease all use of the Site.
2. Definitions
- Site: the online service accessible at www.jde-jobs.com.
- Publisher: SYMAN CONSULTING, the company publishing the Site.
- User: any person accessing the Site, whether or not they hold an Account.
- Visitor: an unregistered User, freely browsing the published job listings.
- Candidate: a registered User who consults and applies for job offers.
- Employer: a professional User publishing job listings, subject to the General Terms and Conditions of Sale.
- Account: the secure personal space created by a User via the Clerk authentication service.
- Listing: a job offer published by an Employer on the Site.
- Application: a response submitted by a Candidate to a Listing, including in particular a CV and a message.
3. Access to the Site
3.1. Free Access
Access to the Site and browsing of Listings are free of charge for Visitors and Candidates. Creating a Candidate Account is required to apply for a position, save a listing as a favourite, or view application history.
3.2. Paid Access
The publication of Listings by Employers constitutes a paid service governed by the General Terms and Conditions of Sale.
3.3. Availability
The Site is accessible 24 hours a day, 7 days a week. The Publisher reserves the right to temporarily suspend access to the Site for maintenance operations, updates, or in the event of force majeure, without prior notice and without incurring any liability.
4. User Account
4.1. Creation
An Account is created via the third-party authentication service Clerk (creation by email/password or via a supported identity provider). The User undertakes to provide accurate, up-to-date, and complete information.
4.2. Confidentiality of Credentials
The User is solely responsible for the confidentiality of their login credentials. Any action performed from an Account is deemed to have been performed by its holder. Any suspected fraudulent use of the Account must be reported without delay to contact@jde-jobs.com.
4.3. Uniqueness
Each natural person may hold only one Account per category (Candidate / Employer). The creation of multiple Accounts for the purpose of circumventing these ToU may result in their suspension or termination.
5. User Obligations
The User undertakes to use the Site in compliance with:
- applicable laws and regulations, in particular regarding employment law, non-discrimination, personal data protection, intellectual property, and criminal law;
- these ToU and, where applicable, the General Terms and Conditions of Sale;
- the rights of third parties, including other Users;
- the purpose of the Site, namely connecting professionals within the JD Edwards (Oracle ERP) ecosystem.
6. Prohibited Conduct
The following conduct is prohibited on the Site, this list being non-exhaustive:
6.1. For Employers
- publishing fictitious, misleading, or non-existent job listings that do not correspond to any genuinely available position;
- publishing listings unrelated to the JD Edwards ecosystem;
- publishing listings containing discriminatory selection criteria within the meaning of articles L1132-1 et seq. of the Labour Code (origin, sex, age, family status, state of health, sexual orientation, political opinions, etc.);
- publishing listings containing misleading information about the position, the employer, the remuneration, or the working conditions;
- soliciting, outside of the application process, payments or services at the expense of Candidates;
- using application data for purposes other than recruitment for the relevant position.
6.2. For Candidates
- submitting fictitious, misleading, or mass applications without genuine intent to apply;
- falsifying CVs, references, or personal information;
- any abusive, harassing, defamatory, or inappropriate communication towards Employers.
6.3. For All Users
- automated extraction (scraping, crawling) of Listings, Candidate data, or any other data from the Site;
- distributing viruses, malware, or any content harmful to the integrity of the Site;
- any attempt at unauthorised access to the Site, its servers, or the Accounts of other Users;
- using the Site for spam, unsolicited advertising, or the promotion of third-party products and services;
- distributing unlawful content (hateful, discriminatory, defamatory, etc.).
7. Moderation and Control
7.1. Ex-Post Moderation
In accordance with its status as a hosting provider within the meaning of the LCEN, the Publisher does not carry out systematic prior monitoring of published content. It does, however, implement:
- AI-assisted moderation at the time of initial publication of Listings;
- human review of content reported as problematic;
- automated controls to prevent spam and abusive behaviour.
7.2. Reporting Unlawful Content
Any User may report content they consider unlawful by writing to contact@jde-jobs.com, specifying the identifier of the Listing or Application concerned as well as the grounds for the report. Bad-faith reporting engages the civil and criminal liability of its author in accordance with article 6-I-4 of the LCEN.
8. Sanctions
In the event of a breach of these ToU, the Publisher may, at its sole discretion and in accordance with the severity of the breach, apply the following measures:
- Warning by email sent to the User;
- Temporary suspension of the Account, publications, or access to certain features;
- Permanent termination of the Account and removal of associated content.
In the event of a serious breach (false profile, fraud, harassment, distribution of unlawful content, attempted intrusion, etc.), the Publisher reserves the right to proceed with the immediate termination of the Account without prior warning and to report the facts to the competent authorities.
No refund shall be due in the event of termination for a breach attributable to the User.
9. Intellectual Property
9.1. Publisher's Property
The Site, its structure, architecture, graphic charter, texts, logos, trademarks, databases, and all other elements of which it is composed are the exclusive property of SYMAN CONSULTING or its licensors, and are protected by French and international intellectual property law.
Any reproduction, representation, modification, publication, adaptation, commercial exploitation, or reuse, in whole or in part, of the Site's elements, without prior written authorisation from the Publisher, is prohibited and constitutes an infringement subject to sanctions under articles L335-2 et seq. of the Intellectual Property Code.
9.2. Content Published by Users
Users retain full ownership of the content they publish or upload to the Site (Listings for Employers; CVs, application messages, and profile data for Candidates).
By publishing or uploading content to the Site, the User grants SYMAN CONSULTING a non-exclusive, royalty-free licence limited to the duration of the said content's presence on the Site, including the right to reproduce, host, display, translate (for the purposes of the Site's internationalisation), and transmit the content to the relevant recipients (in particular, transmission of Applications to Employers), solely for the purposes of operating the Site and performing the services.
The User warrants that they hold the necessary rights over the content they publish and that such content does not infringe the rights of third parties.
10. External Links
The Site may contain links to third-party websites (Employers' websites, Candidates' LinkedIn profiles, etc.). The Publisher exercises no control over the content of these third-party sites and accepts no liability for their content, operation, or data protection policy.
11. Personal Data
The processing of Users' personal data is governed by the Site's Privacy Policy, which complies with Regulation (EU) 2016/679 (GDPR). The use of cookies is described in the Cookie Policy.
12. Amendment of the ToU
The Publisher reserves the right to modify these ToU at any time. The applicable ToU are those in force at the date of use of the Site. Any material modification is brought to the attention of Users with an active Account via a message within the Site or by email.
13. Governing Law and Jurisdiction
These ToU are governed by French law.
Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts within the jurisdiction of the Court of Appeal of Versailles, subject to the application of any mandatory overriding provisions to the contrary.
