General Terms of Sale

1. Preamble
These General Terms and Conditions of Sale (hereinafter "GTC") govern the purchase of job listing publication services offered by SYMAN CONSULTING on the website www.jde-jobs.com (hereinafter "the Site"). Any order placed on the Site constitutes full and unconditional acceptance of these GTC by the employer or their representative.
2. Seller Identity
SYMAN CONSULTING — A single-member limited liability company (société à responsabilité limitée à associé unique) with a share capital of €5,000, registered with the Versailles Trade and Companies Registry (RCS) under number 790 001 507, with its registered office at 192 Rue de la Bruyère, 78300 Poissy, France.

3. Scope — Service Reserved for Professionals
The Site and the services offered are exclusively intended for professionals acting within the framework of their economic activity (employers, recruitment firms, placement agencies, freelancers), to the exclusion of any person acting for private or non-professional purposes.
By placing an order, the Buyer (hereinafter "the Employer") declares and warrants that they:
- act exclusively within the framework of their professional activity;
- hold the authority and legal capacity to contractually bind the organisation on whose behalf they are acting;
- are not a consumer within the meaning of the Consumer Code.
No order may be placed on a personal basis.
4. Description of Services
SYMAN CONSULTING offers three job listing publication packages on the Site:

Each published listing is subject to editorial moderation (see article 9).
5. Pricing and Payment Terms
5.1. Pricing
Prices displayed on the Site are expressed in euros (€) exclusive of tax (VAT excluded).
The applicable VAT is automatically calculated and added at the time of payment by our service provider Stripe, based on the Buyer's location and tax status:
- France: French VAT at the applicable statutory rate (currently 20%) added to the price excluding VAT.
- Another European Union member state, Buyer holding a valid intra-EU VAT number: reverse charge of VAT; no VAT is invoiced by SYMAN CONSULTING (the statement "Reverse charge — Article 196 of Directive 2006/112/EC" is shown on the invoice).
- Third countries (outside the European Union): no French VAT is invoiced. The Buyer is responsible for declaring and paying any tax applicable in their country.
A detailed invoice stating the price excluding VAT and the applicable VAT rate and amount is made available to the Buyer upon completion of payment.
5.2. Payment
Payment is made online by credit or debit card via the payment service provider Stripe. SYMAN CONSULTING does not directly collect or store the Employer's banking details.
Payment is due immediately upon ordering. An electronic invoice is made available to the Employer upon completion of payment, accessible from their personal account and, where applicable, their subscription management portal.
6. Performance of Services
6.1. Immediate Publication
Upon confirmation of payment by Stripe, the listing is submitted for editorial moderation and published on the Site as soon as possible (generally within a few minutes in the case of auto-approval, or within 24 to 48 working hours in the case of manual review).
6.2. Immediate Commencement of Service — Waiver of Right of Withdrawal
As the service is reserved for professionals (see article 3), the right of withdrawal provided for under articles L221-18 et seq. of the Consumer Code does not apply.
As an additional precaution, and in the event that a Buyer's status as a consumer were to be recognised, the Employer expressly acknowledges that performance of the service commences immediately upon confirmation of payment (queuing for moderation and subsequent publication of the listing), which extinguishes any right of withdrawal pursuant to article L221-28 of the Consumer Code.
7. Duration and Renewal
7.1. Single Post and Featured Post Packages
The Single Post and Featured Post packages are services performed on a one-time basis. The listing is published for a period of 30 days (Single Post) or 60 days (Featured Post) respectively, from its effective publication date, after which it expires automatically. No tacit renewal is applied.
7.2. Agency Unlimited Package
The Agency Unlimited package is a monthly subscription that renews automatically. Each subscription period runs from the effective subscription start date for a period of one month, renewable automatically.
The Employer may cancel their subscription at any time from their personal account via the Stripe subscription management portal. Cancellation takes effect at the end of the current subscription period, with no refund of any pro-rata portion of the period already in progress. Listings published prior to cancellation remain visible until the end of their contractual exposure period.
8. Refund Policy
In accordance with article 6.2, services are performed upon confirmation of payment and give rise to no refund after publication of the listing, except in the following cases:
- manifest and established failure of the Site attributable to SYMAN CONSULTING (for example, total and prolonged inability to publish the listing);
- billing error attributable to SYMAN CONSULTING or its payment service provider;
- any mandatory provision of applicable law, in particular regarding data protection.
Any refund request must be sent to contact@jde-jobs.com within a reasonable timeframe, accompanied by supporting documentation.
9. Editorial Moderation
SYMAN CONSULTING reserves the right, at its sole discretion and without prior notice, to refuse, suspend, modify or remove any listing that does not comply with:
- these GTC or the Site's General Terms of Use;
- applicable French and European legislation, in particular regarding employment law, non-discrimination, data protection and criminal law;
- the Site's editorial policy (listings relating to the JD Edwards ecosystem).
Moderation is carried out after publication, using automated means (AI-assisted moderation) and human review. In the event that a listing is removed for serious non-compliance attributable to the Employer, no refund shall be due.
10. Warranties and Limitation of Liability
10.1. Best Efforts Obligation
SYMAN CONSULTING undertakes to provide the Site and the services under a best efforts obligation and deploys its best endeavours to ensure the availability, security and performance of the Site. No contractual service level agreement (SLA) is provided.
10.2. Liability Cap
The liability of SYMAN CONSULTING, for all heads of loss combined, is expressly limited to the total amount of sums actually paid by the Employer in respect of the services that are the subject of the dispute during the twelve (12) months preceding the occurrence of the event giving rise to liability.
10.3. Exclusion of Indirect Damages
SYMAN CONSULTING shall not be liable for indirect, intangible or consequential damages, including in particular loss of turnover, loss of customers, loss of business opportunity, loss of reputation or reputational harm.
10.4. Listing Content
In accordance with article 6-I-2 of the Act for Confidence in the Digital Economy of 21 June 2004 (LCEN), SYMAN CONSULTING acts as a host with regard to listings published by Employers. As such, SYMAN CONSULTING is not subject to a general obligation to monitor content and cannot be held liable for the content of listings, unless it has had actual knowledge of manifestly unlawful content and failed to act promptly to remove it.
11. Force Majeure
SYMAN CONSULTING shall not be held liable for the non-performance or delay in the performance of its obligations where such non-performance results from a force majeure event within the meaning of article 1218 of the Civil Code, including in particular, without this list being exhaustive: widespread outage or interruption of hosting services, payment providers, authentication or messaging services; malicious cyberattack; decision by a public authority; natural disaster.
12. Personal Data
The processing of personal data in the context of these GTC is governed by the Site's Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR).
13. Amendments to the GTC
SYMAN CONSULTING reserves the right to amend these GTC at any time. The GTC applicable to an order are those in force at the date the order is placed. Any material amendment will be notified by email to Employers with an active Agency Unlimited subscription.
14. Governing Law and Jurisdiction
These GTC are governed by French law.
Any dispute relating to their formation, interpretation or performance shall fall under the exclusive jurisdiction of the courts within the jurisdiction of the Versailles Court of Appeal, subject to the application of any mandatory overriding provisions.
